1. Introduction

These Terms & Conditions (“Agreement”) govern your use of SmartPay services including mobile applications, APIs, POS systems, and payment platforms.

SmartPay is a financial technology platform and operates in collaboration with regulated financial institution partners.

3. Services

SmartPay provides digital payment processing services including:

  • Bill payments throuhg multiple digital channels
  • POS-based transactions
  • QR and account-based payments

SmartPay is not a bank; financial services are delivered via partner institutions.

4. Payments

You must maintain sufficient funds in your account to complete payments. We or partner institution reserve the right to block or reverse any transaction—even after funds have been debited—in the following circumstances:

  • Your instructions are incomplete or unclear
  • We suspect fraudulent or unlawful activity on your account
  • The payment is restricted by applicable law
  • Action is required to comply with a court, regulatory, or government order
  • The transaction exceeds your payment limits

5. User Responsibility

We encourage users to regularly monitor their account activity, maintain sufficient funds, and promptly address any issues that may arise.

This policy is designed to ensure a reliable, secure, and cost-effective service for all users. We appreciate your understanding and cooperation. Users are advice to:

  • Maintain account security
  • Monitor transactions regularly
  • Provide accurate information
  • Comply with applicable laws

6. Use of Information

By using SmartPay, you consent to the processing of your data in accordance with our Privacy Policy.

7. Refunds

  • Refunds must be requested from the merchant/biller
  • SmartPay may assist in dispute coordination
  • Failure to provide required information may result in delays

If you require a refund for a payment, you should contact the institute to whom the payment was made and follow their respective refund process.

Monitoring for suspicious activity is a critical part of our operations. You are required to promptly comply with any request for additional information regarding transactions you have conducted. Failure to do so may result in the suspension or closure of your account/payment.

If we exercise our right to limit or deny your access to our services, we shall not be liable for any resulting consequences, including delays, losses, damages, or inconvenience.

8. Restrictions

You agree not to use the services for any unlawful or prohibited activities, including but not limited to:

  • Engaging in fraudulent transactions
  • Participating in money laundering or the financing of illegal activities
  • Transferring funds to unregistered users or merchants

Violation may result in account suspension or termination.

9. Liability & Disclaimer

Our payment gateway services are provided on an “as is” and “as available” basis, without any representations, warranties, or guarantees of any kind, whether express or implied.

We shall not be liable for any losses or damages arising from, including but not limited to:

  • Unauthorized access risks
  • Service interruptions, delays, or technical failures
  • Errors, inaccuracies, or omissions in the information provided

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, losses, or expenses arising out of or in connection with your use of the payment gateway services or any breach of these Terms.

This limitation of liability helps ensure the continued availability and stability of our services for all users.

10. Changes to Terms

SmartPay may update these terms. Continued use implies acceptance.

These Terms are governed by the laws of the Islamic Republic of Pakistan.
